Charter Voyages SA and its data protection officer (Mr Kevin Howells, data controller) are responsible for collecting and processing your personal data in the course of its activities.

Our business is to provide a comprehensive range of travel services to our customers.

    • A co-traveler of our clients;
    • A person interested in our products or services and you provide us with your personal data (e.g., in-store, on our websites, or during events) so that we can contact you.

When you provide us with personal data concerning other individuals, please ensure that you inform them about the disclosure of their data and invite them to read this data protection statement. We will also do the same whenever possible (e.g., if we have the person’s contact details).

  1. FOR WHAT PURPOSES AND ON WHAT LEGAL BASIS DO WE USE YOUR PERSONAL DATA?

2.1. Contract Performance and Legitimate Interest
In this section, we explain the purposes and legal basis on which we process your personal data. Primarily, we use your personal data to perform a contract to which you are a party or to take pre-contractual measures at your request. However, we may also process your personal data to fulfill our legitimate interest or that of third parties.

• Enter into a (travel) contract with you. We may process personal data to register you as a new client, enter into a contract, and execute it with you;

• Provide services related to the preparation and execution of a trip;
• For insurance purposes;
• Offer advisory services;
• Provide assistance during travel difficulties, if needed;
• Communicate with you. We may process personal data when you wish to contact us, request information about our company or services, or when the contract needs to be updated;
• Respond to your requests and assist you;
• Manage the termination of the contract.

When we base processing activities on a legitimate interest, we balance this interest against your interests or fundamental rights and freedoms to ensure a fair equilibrium. As a travel service provider, we use your personal data to:
• Continue developing our products and services;
• Strengthen cybersecurity, manage our platforms and websites, and ensure business continuity;
• Implement information technology solutions;
• Maintain the operational status of information systems;
• Improve the automation and efficiency of our operational processes and customer services (e.g., tracking your requests and enhancing your satisfaction based on personal data collected during our interactions, such as emails);

If you are one of our clients and unless you object, we may send you offers for our products and services. We will ensure that these commercial offers concern products or services that meet your needs and complement those you already benefit from. You can object at any time.

  • Health data, e.g., information on special health needs or illnesses and accidents occurring during a trip;
  • Financial information, e.g., payment details, credit card number, bank account details;
  • Data regarding your habits and preferences, in terms of using our products and services (e.g., meal requests);
  • Data collected during our interactions with you, such as feedback, suggestions, and needs recorded during in-person exchanges at our offices or phone conversations (meeting notes or recorded conversations), emails, chats, chatbot exchanges, interactions on our social media pages, and any complaints;
  • Connection and tracking data such as cookies and trackers for non-advertising or analytical purposes on our websites, online services, applications, and social media pages;
  • Device data (mobile phone, computer, tablet, etc.), IP address, technical characteristics, and identification data;
  • Personalized login credentials or security features used to access our website and applications.
  1. FROM WHOM DO WE COLLECT PERSONAL DATA?
    Generally, we collect personal data directly from you. However, we may also collect it from other sources.

Sometimes, we collect data from public sources:

  • Publications/databases made available by official authorities or third parties (e.g., official commercial register, business registry);
  • Websites/social media pages of legal entities or business clients containing information you have disclosed (e.g., your own website or social media page);
  • Public information, such as press publications.

  • Our clients (e.g., co-travelers);
  • Our service providers (including foreign service providers);
  • Third parties such as credit reference agencies and fraud prevention agencies;
  • Data brokers, who are required to ensure that they collect relevant information lawfully.
  1. WITH WHOM DO WE SHARE YOUR PERSONAL DATA AND WHY?
    To achieve some of the purposes described in this data protection statement, particularly for organizing a trip, we may share your personal data with:
  • Our service providers in the destination country (e.g., agencies, guides, hotel bookings, transfer and excursion services), transportation providers (airlines, trains, car rental services, etc.), and accommodation operators (hotels, hostels, etc.);
  • Subcontractors who provide services on our behalf (e.g., IT services, logistics, printing services, telecommunications, debt collection, consulting, distribution, and marketing);
  • Certain regulated professionals, such as lawyers, notaries, or auditors when necessary under specific circumstances (litigation, audits, etc.);
  • Partners for advertising, market research, and opinion surveys;
  • Partners supporting us in investigating violations (e.g., fraud), or in exercising or defending legal rights;
  • Authorities and official services (e.g., tax authorities, destination country embassies) in case of legal or administrative obligations (e.g., retention obligations, visa applications, obtaining information on entry conditions).
  1. INTERNATIONAL TRANSFERS OF PERSONAL DATA

In the case of international transfers from Switzerland or the European Economic Area (EEA) to a non-EEA country (third country), your personal data may be transferred across borders. In particular, you should expect that your data will be transmitted to your destination countries, but also to other countries in Europe, the USA and around the world where service providers commissioned by us are based. If the FDPIC or the European Commission has recognised that a third country offers an adequate level of data protection, your personal data may be passed on on this basis.

We retain your personal data for the period required to fulfil our contractual obligations and to comply with applicable laws and regulations or for a different period of time, in accordance with our legitimate business interests, such as

proper bookkeeping and response to legal claims or requests from authorities.

You have rights that allow you to exercise effective control over your personal data and how we process it. Below we explain your rights in relation to your personal data.

8.1. You can request access to your personal data

If you wish to have access to your personal data, we will provide you with a copy of the personal data you have requested as well as information relating to its processing. Your right of access may be limited in the cases provided for by laws and regulations.

8.2. You can request the rectification of your personal data

If you believe that your personal data is inaccurate or incomplete, you may request that such personal data be amended or supplemented accordingly. In some cases, supporting documents may be required.

8.3. You can request the deletion of your personal data

If you wish, you can request the deletion of your personal data, insofar as this is permitted by law.

8.4. You may object to the processing of your personal data on the basis of legitimate interests

If you do not agree with a processing activity on the basis of a legitimate interest, you may object to it, on grounds relating to your particular situation, by informing us precisely of the relevant processing activity and the reasons for your objection. 8.5. You may object to the processing of your personal data for commercial prospecting purposes

You have the right to object at any time to the processing of your personal data for the purposes of commercial prospecting, including profiling, insofar as it is related to such direct marketing.

8.7. You have rights against automated decision-making

However, we may automate such a decision if it is necessary for the conclusion or performance of a contract with us, if it is permitted by regulation or if you have given your consent. In all cases, you have the right to contest the decision, express your point of view and request the intervention of a competent person to review the decision.
